NetLoad Analysis Package: Licence and Disclaimer

1. Terms of Reference

The "software" or "package" refers to part or all of the
NetLoad Analysis Software package (including but not limited
to NetLoadD the Daemon, NLCGI the CGI Interface and the tools
packages such as addhost).

The "supplier" or "provider" refers to PurplePixie Systems
a not-for-profit software and network systems development
group.

The "author", "tosser" or "developer" refers to David Cutting,
the primary software architect of this system.

The "reseller" or "retailer" refers to someone other than
the end-user, author or supplier selling the package to
another reseller/retailer or an end-user.

The "end-user" is the final user of the package (and can be
referred to as the "customer" if the package is sourced from
a retailer or reseller).

"Private Use" is defined as usage for purely personal and
non-buisiness, non-commercial, non-governmental and non-
organisational use.

"Not for Profit Use" is defined as usage in a non-commercial
and non-governmental use for example a charity, community
project, not-for-profit organisation (non-government
affiliated) or volentary group.

"Governmental Use" is defined as usage by any government-linked
or directly publically funded organisation.

"Commercial Use" is defined as usage by a commercial organisation
(any business or sole trader).

NetLoad is (C) Copyright 2003 David Cutting, all rights reserved.

Copyright for Private and Not for Profit Use:

The product is provided totally free of charge for private or
not for profit uses as defined in the Terms of Reference. The
product may be altered (source code or any part changed) and made
available for free download under the following conditions:

 - This licence agreement must remain in place for any deritive or
 part of the product and be clearly made available at time of and
 with any downloads.
 - Original headers, Copyright and licence information must be shown
 within all sections of original product code used.
 - For versioning reasons, the offshoot build ID must be clearly
 identified with the textual description of the offshoot when
 version information is requested from any portion of the product.

Copyright of Commercial Use:

This product is currently provided totally free of charge in it's
standard binary and compiled versions for Commercial Use as defined
in the Terms of Reference. Commercial Use of the product for
development and any use of source code is forbidden without the
express permission of the developer or provider, please contact the
developer or provider for further information.

Copyright for Governmental Use:

United States Government: This product is subject to a 45,000 GBP
(Great British Pounds Sterling) licence feeper interface per node.
Please contact the developer or provider for further information.

Non-United States Government: This product is currently provided
to all Non-US Governments or governmental organisations totally
free of charge for use and under the same conditions imposed under
the Copyright for Private and Not for Profit Use.



3. Limitation of Liability

This product is provided as-is with no guarentees made as to the
stability, functionality, security and usability thereof. Neither
the developer or the provider accept any liability for loss of data,
time, money or anything else arising as a direct result, possibly as
a result of or even remotely as a result of the use of this product.
